Article 40 of the Constitution of the Republic of Cyprus, as amended, bars the incumbent President from seeking a third term. This is not a matter of retroactivity but one of immediate effect. The test shall be applied on the day candidacies are submitted for the election.
If the amendment were to have a retroactive effect, this would mean invalidating the results of previous elections. On the contrary, this Blog piece argues that what it does is to create a disqualification regarding future elections.
